Welcome to SimVerse HQ (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of www.simversehq.com (the “Website”) and any related services (collectively, the “Services”).
By accessing or using our Services, placing an order, or clicking to accept these Terms, you agree to be bound by them.
If you do not agree, please do not use our Services.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement. If you use the Services on behalf of a company or organization, you represent that you have authority to bind that entity.
2. Orders and Payment
2.1 Product Availability
All products are subject to availability. We reserve the right to limit quantities or discontinue products at any time.
2.2 Pricing
All prices are listed in U.S. Dollars and are subject to change without notice prior to order acceptance. Prices do not include applicable taxes unless explicitly stated.
2.3 Payment Methods
We accept major credit cards, PayPal, Shop Pay, Apple Pay, Google Pay, Affirm financing, ACH transfer, and wire transfer. Payments are processed securely through Shopify and authorized third-party processors.
You agree to provide accurate and current billing information.
3. Anti-Chargeback and Payment Disputes
Before initiating a chargeback or payment dispute, you agree to contact us at cs@simversehq.com to attempt resolution.
Filing a fraudulent or unjustified chargeback constitutes a breach of these Terms. We reserve the right to recover associated fees, costs, and collection expenses to the fullest extent permitted by law.
4. Third-Party Fulfillment and Installation
SimVerse HQ is an authorized reseller and order coordination partner.
Unless explicitly stated in writing, we do not manufacture products, warehouse inventory, or physically handle, assemble, or install products.
Products may be fulfilled and installed (where applicable) by third-party manufacturers or partners. We are not responsible for installer conduct, structural conditions of your property, site readiness, building code compliance, or electrical or construction conditions.
4.1 Manufacturer Responsibility
Buyer acknowledges that SimVerse HQ does not design, engineer, manufacture, or test the Products. All product design, manufacturing, safety compliance, labeling, and defect-related responsibilities are solely the responsibility of the original manufacturer. Buyer agrees that any claims relating to product defects, design defects, manufacturing defects, warnings, or safety compliance shall be directed solely to the manufacturer under the applicable manufacturer warranty.
Nothing herein limits any rights Buyer may have under applicable law.
5. Site Readiness and Installation Responsibility
You are solely responsible for ensuring adequate space and structural integrity, compliance with local building codes and regulations, a safe installation environment, and proper electrical infrastructure.
By purchasing products requiring installation, you acknowledge that use of simulator equipment involves inherent risks, including potential property damage or personal injury.
You assume responsibility for safe use and supervision.
6. Commercial Use
If products are purchased for commercial or public use, you agree that you are responsible for compliance with zoning, ADA, and regulatory requirements, will maintain appropriate general liability insurance, and will ensure equipment is used under appropriate supervision.
SimVerse HQ makes no representations regarding suitability for specific regulatory requirements.
7. Shipping and Risk of Loss
All purchases are made pursuant to a shipment contract. Risk of loss and title transfer to you upon delivery to the carrier.
Freight deliveries must be inspected at time of receipt. Failure to document visible damage on the delivery receipt may limit freight claims.

8. Returns and Refunds
Returns are governed by our Return and Refund Policy.
Simulator systems and custom products are final sale once shipped except as expressly stated in that policy.
Restocking fees of up to 15 percent may apply where permitted.
9. Intellectual Property
All content on the Website is owned by SimVerse HQ or its licensors and is protected by intellectual property laws.
You may not reproduce, distribute, or exploit content without written permission.
10. Prohibited Conduct
You agree not to use the Website for unlawful purposes, attempt unauthorized access, interfere with system security, or submit false or misleading information.
11. Disclaimer of Warranties
11.1 Services Disclaimer
The Services and Website are provided “AS IS” and “AS AVAILABLE.”
Product warranties, if any, are provided solely by the manufacturer. SimVerse HQ does not independently warrant products unless expressly stated in writing.
11.2 Product Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMVERSE HQ DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
ALL PRODUCTS ARE SOLD SUBJECT ONLY TO THE APPLICABLE MANUFACTURER’S WARRANTY, IF ANY. SIMVERSE HQ MAKES NO INDEPENDENT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE PRODUCTS.
NO ORAL OR WRITTEN STATEMENT, DESCRIPTION, SAMPLE, OR REPRESENTATION SHALL CREATE ANY WARRANTY NOT EXPRESSLY SET FORTH IN A WRITTEN AGREEMENT SIGNED BY SIMVERSE HQ.
12. Limitation of Liability
To the maximum extent permitted by law, SimVerse HQ’s total liability arising from any claim related to a product or service shall not exceed the amount paid for the specific product giving rise to the claim.
We are not liable for indirect, incidental, consequential, special, or punitive damages.
13. Indemnification
You agree to indemnify and hold harmless SimVerse HQ from claims arising out of your misuse of products, failure to maintain safe installation conditions, commercial operation of equipment, or violation of these Terms.
14. Force Majeure
We are not liable for delays or failure to perform caused by events beyond our reasonable control, including acts of God, carrier delays, supply chain disruptions, or governmental actions.
15. Arbitration and Dispute Resolution
Any dispute arising from these Terms shall be resolved through binding arbitration in the State of Texas, administered by a recognized arbitration provider.
Disputes will be resolved on an individual basis. You waive any right to participate in class actions or class arbitration.
Either party may pursue claims in small claims court where jurisdiction allows.
You may opt out of arbitration within 30 days of accepting these Terms by sending written notice to cs@simversehq.com.
16. Governing Law
These Terms are governed by the laws of the State of Texas. Venue for any permitted court action shall lie exclusively in Travis County, Texas.
17. Electronic Communications
By using our Services, you consent to receive communications electronically, including agreements, disclosures, and order confirmations.
18. Export Compliance
You agree not to export or use products in violation of U.S. export laws or regulations.
19. Modifications
We reserve the right to update these Terms at any time. Continued use of the Website constitutes acceptance of revised Terms.
20. Non-Reliance
You acknowledge that in using the Services or purchasing Products, you are not relying on any representations, statements, projections, marketing materials, demonstrations, or warranties not expressly set forth in these Terms or in a written agreement signed by SimVerse HQ.
No employee, agent, or representative of SimVerse HQ has authority to modify or expand the terms of these Terms except through a written amendment signed by an authorized representative of SimVerse HQ.
21. Additional Policies
The Affiliate Disclosure and Testimonials Disclaimer, Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies posted on our website are incorporated by reference into these Terms and form part of the agreement between you and SimVerse HQ.
